End-User Terms of Use

Effective: 15 May 2025 · Version 2.1

These Terms of Use ("Terms") govern your personal use of the Wedapt platform ("Platform"), operated by Wedapt GbR, Erkstraße 2, 12043 Berlin, Germany (contact@wedapt.ai).

Wedapt is provided to students, teachers, and school staff exclusively through schools. Your school has entered into a separate Master Services Agreement and Data Processing Agreement with Wedapt. These Terms govern your individual account and conduct on the Platform.

By clicking "I Accept" at first login, you confirm that you have read and agree to these Terms.

1. Eligibility and Consent

  • If you are under 16, your school has confirmed that your parent or guardian has given written consent before your account was created, as required by Article 8 GDPR and applicable German school law (e.g., § 64a Berlin Schulgesetz).
  • If you are 16 or older, you may accept these Terms on your own behalf.
  • Access to the Platform is granted and managed by your school. You may not create an account independently.

2. No Personal Data in Prompts

3. AI Outputs — Disclaimer and Human Oversight

Wedapt uses artificial intelligence to generate tutoring content, feedback, and learning recommendations. AI outputs may contain errors, omissions, or inaccuracies.

  • Do not rely on AI answers as the sole basis for graded work without checking with your teacher.
  • Teachers retain full human oversight of any AI-generated assessment or grading output.
  • Wedapt makes no warranty as to the accuracy or completeness of AI-generated content.

4. Acceptable Use

You agree not to:

  • Upload, share, or enter illegal, abusive, threatening, or infringing content.
  • Use the Platform for academic dishonesty (e.g., submitting AI-generated work as your own without disclosure where your school prohibits this).
  • Attempt to probe, reverse-engineer, or compromise the Platform's security or infrastructure.
  • Share your login credentials or allow others to use your account.
  • Use the Platform for any commercial purpose not authorized by your school.

5. Account Security

You are responsible for keeping your login credentials secure. You must not share your password with anyone. If you suspect unauthorized access to your account, notify your teacher or school administrator immediately.

6. Content Ownership

You retain ownership of any content you create on the Platform (e.g., written answers, notes). By using the Platform, you grant Wedapt a limited, non-exclusive license to process that content solely to deliver the service to you. We do not use your content to train AI models beyond what is required to provide the service, and we do not sell your content.

7. Privacy and Data Hosting

All personal data processed through Wedapt is hosted within the European Union, primarily in data centers located in Germany (Frankfurt am Main), in accordance with GDPR and the German Federal Data Protection Act (BDSG). A full list of our sub-processors is available in our Privacy Policy.

8. Termination and Data Deletion

Your access to the Platform is controlled by your school. Your school may suspend or remove your account at any time. When your school's contract with Wedapt ends, your data is retained for the period stated in our Privacy Policy and then deleted.

To request export or deletion of your personal data, contact your teacher or school administrator, or email contact@wedapt.ai directly.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Wedapt is not liable for the accuracy of AI-generated content.
  • Wedapt's total liability to you for any claim arising from these Terms is limited to the fees paid by your school to Wedapt in the 12 months preceding the claim.
  • This limitation does not apply to liability for willful misconduct, gross negligence, death or personal injury, or violations of data-protection law.

10. Governing Law

These Terms are governed by the laws of Germany. Any disputes will be resolved in the courts of Berlin, unless applicable consumer-protection law provides otherwise.

11. Changes to These Terms

Wedapt will notify your school of any material changes to these Terms before they take effect. Continued use of the Platform after the notified effective date constitutes acceptance of the updated Terms.

12. Role-Specific Responsibilities

12A. Students

In addition to the rules above:

  • Never type personal information into the AI tutor. This is the most important rule. See Section 2 for the full list of what not to enter.
  • If the AI tutor gives you an answer that seems wrong, check with your teacher before using it for graded work.
  • The Platform is for learning, not socializing or personal messaging.
  • If you see something on the Platform that worries you or seems wrong, tell your teacher.

12B. Teachers

In addition to the rules above:

  • You are responsible for supervising your students' use of the Platform and for ensuring they understand the rules in these Terms, especially Section 2.
  • You must not use AI-generated assessment or grading output as the sole basis for a student's grade. Human judgment and review are required.
  • You must report any suspected data-protection incidents (e.g., a student accidentally typing personal information into a prompt) to your school administrator and to Wedapt at contact@wedapt.ai promptly.
  • Student data you access through the Platform is confidential. Do not share it outside the context of your educational duties.

AI Co-pilot — Acceptable Use

When using the Teacher Co-pilot:

  • Do not enter student personal data beyond what is strictly necessary for the task. The Co-pilot can retrieve class and progress data automatically — do not type out full student names, ID numbers, health information, or other sensitive personal details into the chat.
  • Do not use Co-pilot outputs as the sole basis for a grading or disciplinary decision. All AI-generated assessments, rubrics, or recommendations require your independent professional review and judgment before being applied to any student.
  • Review all AI-generated materials (lesson plans, worksheets, assessments) for accuracy, pedagogical appropriateness, and alignment with your school's curriculum standards before using them with students. Wedapt does not guarantee the accuracy, completeness, or curriculum compliance of AI outputs.

AI-Generated Materials — Ownership

Materials you generate using the Teacher Co-pilot (lesson plans, worksheets, assessments, rubrics) are owned by you or your employing school. By saving such materials on the Platform you grant Wedapt a limited, non-exclusive licence to store and serve those materials within the Platform solely for the purpose of delivering the service to you and your school. Wedapt does not claim ownership of AI-generated materials and does not use them for any purpose beyond service delivery.

Web Search Tool

The Teacher Co-pilot may search the web and fetch external URLs to assist with educational research. You are responsible for ensuring that any third-party content retrieved in this way and incorporated into your teaching materials is used in compliance with applicable copyright and licensing terms. Wedapt is not liable for the content of third-party websites accessed via this feature.

12C. School Staff and Administrators

In addition to the rules above:

  • You are responsible for accurately provisioning and de-provisioning user accounts. Remove accounts promptly when a student or teacher leaves the school.
  • You are responsible for maintaining parental consent records for students under 16 and for ensuring those records are available on request.
  • You must escalate any suspected security incidents or data breaches to Wedapt at contact@wedapt.ai without undue delay and in any case within 24 hours of becoming aware, so that Wedapt can fulfill its 72-hour breach-notification obligation under Article 33 GDPR.
